Terms of Use

These Terms of Use (“Terms”) govern access to and use of the Navo website and software services at navocrm.com (the “Service”) operated by Carepoint LLC (“Carepoint,” “we,” “us,” or “our”). By accessing or using the Service, you agree to these Terms.

1. Eligibility & accounts

You must be at least 18 and able to form a binding contract. If you use Navo on behalf of an agency or other organization, you represent that you have authority to bind that organization, and “you” includes that organization. You are responsible for safeguarding credentials and for activity under your account.

2. The Service

Navo is a sales CRM and communications tool for insurance agencies and agents. Features may include contact records, queues, voice, SMS, email, and related workflows. We may modify, suspend, or discontinue features. Early access features are provided as-is and may change without notice.

You retain rights to content you submit. You grant Carepoint a license to host, process, and display that content solely to provide the Service. You are solely responsible for the legality of your contacts, consent records, scripts, and outbound communications. Telephony and messaging are subject to carrier and provider rules (including Twilio A2P / 10DLC where applicable).

5. Third-party services

The Service may integrate third-party providers (for example hosting, authentication, voice/SMS, email delivery). Their terms and privacy policies apply to their services. Carepoint is not responsible for third-party outages or policy changes outside our control.

6. Fees

If your organization has a paid plan or usage-based charges (voice, SMS, email, numbers), you agree to pay fees as agreed in an order form, invoice, or in-product plan. Usage may be attributed per organization or billing account. Late or failed payment may result in suspension of outbound communications while CRM data remains readable as we determine.

7. Intellectual property

Navo, including software, branding, and documentation, is owned by Carepoint or its licensors. These Terms do not grant you any ownership rights. Feedback you provide may be used by Carepoint without obligation to you.

8. Disclaimer

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAREPOINT DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAREPOINT WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO CAREPOINT FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM.

10. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach, risk, non-payment, or legal reasons. Provisions that by nature should survive (including ownership, disclaimers, and limitations) will survive termination.

11. Governing law

These Terms are governed by the laws of the State of Florida, excluding conflict-of-law rules, unless a written agreement with your organization states otherwise.

12. Changes

We may update these Terms by posting a revised version on this page. Continued use after the effective date constitutes acceptance.
